TERMS & CONDITIONS
Please read these terms and conditions carefully before you confirm your booking and pay your deposit to us. These terms tell you who we are, what services we provide to you, how we provide the services to you, how you and we can change or end the contract, what to do if there is a problem and other important information. 


It also sets out our relationship with the surgical provider and how you will enter into a contract with them to carry out your procedure. If you feel that there is an error in these terms and conditions or that changes are required, please contact us to discuss this.

1. Who are we?

Victoria Aesthetics is a company that puts you in contact with first-class surgeons/clinics abroad. We take care of the complete organization and consultation in advance and finalize the booking with the clinic on your behalf.

2. Our responsibility

For the avoidance of doubt, unless otherwise stated, we act only as an agent in relation to any bookings we make on your behalf and we are not responsible for the performance of the procedure (and our services do not include the performance of the procedure). You must enter into a direct contract with your chosen surgical procedure provider ("Surgical Procedure Provider") when you arrive at the Hospital to undergo your procedure.

3. Documents prior to the procedure


We recommend that you read all documentation provided to you by your surgical provider completely and carefully, as it sets out the conditions for the use of medical services by the surgical provider and the surgical provider is responsible in the event of problems with the procedure. This documentation may be subject to laws other than German law. Therefore, if you have any questions about these conditions, we recommend that you contact a legal advisor in the country where you are having the procedure.


If a traveler is injured, falls ill or dies while staying in the accommodation we have booked or using the services we have booked (including services provided by the service provider), you should notify us and the service provider concerned. Although we have no direct control over the way in which our suppliers conduct and operate their business, we may need to investigate this matter and will assist you in your dealings with them.

4. Changes to your booking/changes to the GTC

If you wish to change the service we provide or a booking with the surgery provider, please contact us. We will let you know if the change is possible and contact the surgical service provider on your behalf. If the change is possible, we will inform you of any changes to the price of our services or the price charged by the surgical provider in relation to the procedure you have booked through us, as well as any other practical issues.

We may make changes to these Terms or the Services from time to time to reflect the procedures and processes of the surgical providers we introduce to you and other legal requirements and changes in our business. We will only make such changes when it is appropriate for us to do so. If we do so, we will notify you and you may then contact us to discuss termination of the contract before the changes come into effect.

5 Our services

5.1 What happens if you do not provide us with all the information we need?


We may need (and will request) information from you so that we can provide you with the services and register you with the surgical services provider. If you do not provide us with this information within a reasonable time of our request, or if you provide us with incomplete or incorrect information, we may either terminate the contract or make an additional charge of a reasonable amount to compensate us for the additional work this requires. We will not be responsible for any delay or partial failure to provide the Services if this is due to your failure to provide us with the required information within a reasonable time of our request.

5.2 We may terminate the service if you do not pay


If you do not pay us for the services or make payment to the surgical services provider by the due date and payment has still not been made, we may suspend the provision of the services until you have paid us the outstanding amounts. We will contact you to let you know that we are suspending the provision of services. In addition to suspending the Services, we may also charge you interest on your overdue payments.

6 Your right to end the contract


6.1 Your rights to end the contract depend on what you have booked, whether something is wrong, how we work and when you decide to end the contract.


6.2 If you want to end the contract because something has changed on our part


If you end a contract for any of the reasons set out in conditions (a) to (d) below, the contract will end immediately and we will refund you in full for any services not provided and you may be entitled to compensation. The reasons for this are:


a. We have notified you of an impending change to our services or these terms that you do not agree with;

b. We have notified you of an error in the price or description of the services we provide or the procedure you have ordered and you do not wish to proceed;

c. there is a risk that the provision of the services or your procedure will be significantly delayed due to events beyond our control;


d. You have the legal right to terminate the contract because we have done something wrong.
 7. refusal of the intervention on your part


You have the right and free will to cancel your appointment at any time. The deposit is non-refundable.

7. How to terminate the contract with us (if you have changed your mind)


If you wish to cancel the procedure, please send us an email with all the details to victoria@victoria-aesthetics.de

8. Our right to end the contract with you


We reserve the right to terminate the contract with you at any time if the following problems occur:


a. You fail to make a payment to us when it is due; or

b. You fail to provide us with information we require to provide the Services within a reasonable time after we have asked you to do so.


If you have any questions or complaints about the services we provide, please contact us. If you have any questions or complaints about the procedure, please contact us and we will contact the surgery provider on your behalf.


Summary of your legal rights. We are required by law to provide services consistent with this contract. As mentioned above, we do not provide medical services, but are only available to you as a contact intermediary between provider and patient.

9 Prices and payment

9.1 Prices


The price of our services and the price of the procedure (which you will pay to the surgical provider) will be the price quoted to you over the telephone or in the course of our email correspondence. We will use our best endeavors to ensure that the price of the procedure quoted to you is correct. However, please see the next points for what happens if we discover an error in the price of the procedure you have booked.


9.2 What happens if we tell you the wrong price

Despite our best efforts, it is always possible that some of the procedures we book on behalf of our clients may be incorrectly priced. We will inform you if we discover that this is the case. If we accept and process your booking where a pricing error is offensive and unmistakable and could reasonably have been recognized by you as an incorrect price, we may terminate the contract and refund any amounts paid by you.


9.3 What type of payment we accept


We accept payment by bank transfer. You will be notified by email when you need to pay. You must pay your deposit fee in advance, with the fee payable to the surgical procedure provider ("Surgery Fee") due upon your arrival in Istanbul, the day before your procedure. Payment of the Surgical Fee)

10. Deposit (Service Fee)

If the procedure cannot take place for medical/health reasons, the deposit (service fee) is non-refundable.

The deposit paid (service fee) is, without exception, non-refundable for the services provided during the initial contact and consultation period.

11. Rights


As mentioned in the previous points, our services do not include the actual performance of the procedure which is carried out by the surgical provider and is the subject of your direct contract with them. Therefore, we will not be liable for any loss or damage you suffer in connection with the procedure itself, unless it results from our failure to exercise reasonable care and skill in relation to the services we provide.

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence in providing our services or by the negligence of our employees, agents or sub-contractors in providing our services; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to our services.

12. Your personal data


Your personal data, including images that you have provided to us, will be used to discuss your procedure with the doctor. 


Afterwards, the image and video material provided by you will be deleted.
